These terms apply to all orders placed through our website at inca-living.com by consumers resident in the European Union and the European Economic Area. By completing an order you confirm that you have read, understood, and accepted these terms.

3. Pricing & Currency

All prices are displayed in EUR and include VAT at the applicable rate for your country of delivery, calculated automatically at checkout via the EU OSS (One-Stop-Shop) VAT scheme. The exact VAT amount is shown during checkout before you confirm your order. We reserve the right to correct obvious pricing errors.

4. Order Acceptance

Your order constitutes an offer to purchase. An order is accepted — and a binding contract is formed — when your payment is successfully captured by our payment processor, Stripe. You will receive an order confirmation email at the address you provided. We reserve the right to refuse or cancel any order at our discretion, in which case we will refund any captured amount in full within 14 days.

5. Payment

Payments are processed securely by Stripe. We accept major debit and credit cards (Visa, Mastercard, American Express), Apple Pay, and Google Pay where available. Card details are never stored on our systems. Stripe is PCI DSS Level 1 certified.

6. Right of Withdrawal

As a consumer in the European Union you have the right to withdraw from your purchase within 14 calendar days of the day you (or a person you designate) receive the goods, without giving any reason, in accordance with the EU Consumer Rights Directive (2011/83/EU).

To exercise this right, you must notify us of your decision to withdraw before the 14-day period expires. You may use the standardised withdrawal form available from the Danish Consumer Ombudsman (Forbrugerstyrelsen), or send a clear written statement to inca@inca-living.com, including your name, order number, and a statement of your intention to withdraw.

7. Defects & Statutory Warranty

If a product is defective or does not conform to what was agreed at the time of purchase, you have a 2-year statutory right of complaint under the Danish Sale of Goods Act (Købeloven § 83 and § 84). This means you may request repair, replacement, a price reduction, or a full refund depending on the circumstances. The right applies to defects that existed at the time of delivery.

To make a complaint, contact us at inca@inca-living.com with your order number and a description (including photographs where possible) of the defect.

8. Limitation of Liability

To the fullest extent permitted by applicable law, INCA Living's liability for any claim arising out of or related to these terms is limited to the price you paid for the product giving rise to the claim. We are not liable for indirect, incidental, or consequential losses. Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded by law.

9. Governing Law & Jurisdiction

These terms are governed by Danish law. Any disputes that cannot be resolved amicably shall be submitted to the courts of Denmark, with Randers as the agreed venue of first instance, subject to any mandatory consumer law protections in your country of residence.

10. Out-of-Court Dispute Resolution

If we cannot resolve your complaint directly, you may contact the Danish Consumer Complaints Board (Forbrugerklagenævnet) via the Centre for Complaint Resolution: www.forbrug.dk. 11. Changes to These Terms

We may update these terms from time to time. Changes take effect when published on this page. The version in force at the time you place an order is the version that applies to that order. We recommend reviewing this page periodically.
