2. Scope
These terms apply to all orders placed through our website at inca-living.com by consumers resident in the European Union and the European Economic Area. By completing an order you confirm that you have read, understood, and accepted these terms.
3. Pricing & Currency
Product prices are displayed in one of four currencies - Danish kroner (DKK), euro (EUR), US dollars (USD), or pounds sterling (GBP) - depending on the currency you select. You can switch currency at any time using the currency selector, and your choice is remembered for your next visit. At checkout, your order is charged in the currency shown, and the price includes VAT or applicable sales taxes where required by law.
Prices in currencies other than Danish kroner are converted from our base prices at the exchange rate in effect when the page is displayed, and may vary slightly over time. The amount you see at checkout is the amount you pay.
For customers within the European Union, VAT is calculated automatically at the applicable rate for the country of delivery through the EU One-Stop Shop (OSS) scheme. The exact VAT amount is displayed during checkout before you confirm your order.
For customers outside the EU, local taxes, customs duties, import fees, or other charges may apply upon delivery. These charges are the responsibility of the customer.
We reserve the right to correct obvious pricing or currency conversion errors.
4. Order Acceptance
Your order constitutes an offer to purchase. When you place an order, the amount is authorised (reserved) on your payment method but not yet charged. A binding contract is formed when we send you an order confirmation email at the address you provided. The reserved amount is only captured - actually charged - when we dispatch your order; see Section 5 below.
We reserve the right to refuse or cancel any order at our discretion. If we cancel before dispatch, the authorisation is released and no charge is taken. If an amount has already been captured, we will refund it in full within 14 days.
5. Payment
Payments are processed securely by Stripe. We accept major debit and credit cards (Visa, Mastercard, American Express), Apple Pay, and Google Pay where available. Card details are never stored on our systems. Stripe is PCI DSS Level 1 certified.
When you place your order, the total is authorised on your payment method - your bank reserves the funds, but no money leaves your account yet. We capture (charge) the payment when your order is dispatched. If your order is cancelled before dispatch, the authorisation is released automatically, typically within a few business days depending on your bank. Authorisations are held for up to 7 days; if we are unable to dispatch within that window we will contact you.
6. Right of Withdrawal
As a consumer in the European Union you have the right to withdraw from your purchase within 14 calendar days of the day you (or a person you designate) receive the goods, without giving any reason, in accordance with the EU Consumer Rights Directive (2011/83/EU).
To exercise this right, you must notify us of your decision to withdraw before the 14-day period expires. You may use the standardised withdrawal form available from the Danish Consumer Ombudsman (Forbrugerstyrelsen), or send a clear written statement to inca@inca.dk, including your name, order number, and a statement of your intention to withdraw.

7. Defects & Statutory Warranty
If a product is defective or does not conform to what was agreed at the time of purchase, you have a 2-year statutory right of complaint under the Danish Sale of Goods Act (Købeloven § 83 and § 84). This means you may request repair, replacement, a price reduction, or a full refund depending on the circumstances. The right applies to defects that existed at the time of delivery.

8. Limitation of Liability
To the fullest extent permitted by applicable law, Inca Living's liability for any claim arising out of or related to these terms is limited to the price you paid for the product giving rise to the claim. We are not liable for indirect, incidental, or consequential losses. Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded by law.
9. Governing Law & Jurisdiction
These terms are governed by Danish law. Any disputes that cannot be resolved amicably shall be submitted to the courts of Denmark, with Randers as the agreed venue of first instance, subject to any mandatory consumer law protections in your country of residence.
10. Out-of-Court Dispute Resolution
If we cannot resolve your complaint directly, you may contact the Danish Consumer Complaints Board (Forbrugerklagenævnet) via the Centre for Complaint Resolution: www.forbrug.dk. You may also use the European Commission's Online Dispute Resolution (ODR) platform: ec.europa.eu/consumers/odr. Our contact email for ODR purposes is inca@inca.dk.
11. Changes to These Terms
We may update these terms from time to time. Changes take effect when published on this page. The version in force at the time you place an order is the version that applies to that order. We recommend reviewing this page periodically.
